Peter from what I understand H.R.861 is backlash because of action taken by the EPA in 2015 to control almost all the water in the United States without approval from congress. The last movement of H.R.861 was; (02/10/2017 Referred to the Subcommittee on Environment. Action By: House Energy and Commerce)  
 I though the Core of Engineers already controlled the nations waterways.
