Even if they did trespass, it doesn't necessarily absolve the landowner of liability to damage done to them.  If a burglar fall downs an unsafe staircase in your house, the fact that he is committing robbery doesn't absolve you of the liability for the unsafe staircase.

Agreed and therein lies the real problem......  Common sense  is no longer common.....
