Well -- your bartender-mom may find that hers is the case that clarifies
that law, if the language on its face isn't clear. This is the way it works
here in the U-S-of-A: if the law itself isn't clear, you ask a judge to
clarify it. And the judge's decision has "precedent" in that state.
The first place the mom (and the lawyers) should look is at the language of
the statute, and all the explanatory information that goes with it. For
example, the "definiitons" section is always one of the first places I go
when trying to interpret legal language ... because it is from those
definitions that all else flows.
Look at anything that was published during the hearings in consideration of
the bill, and the floor debate prior to its being passed. Next, look at the
reports that were issued by the legislative body when the law was passed ...
often they are issued when the Committee has passed the bill, and is now
moving it on to the full legislative body. Look at BOTH the majority and
the minority reports. This gives you an idea of what the Committee
was thinking, when they passed the bill, and can be very influential in a
court haring wehre clarificaiton is sought. Lastly, see if the Governor
issued any statements when he signed the bill into law.
