Karleen - Let's look at the issue of Medela's bottles. Medela can
manufacture and sell bottles on its website and in print ads to the
public. The bottles simply cannot be marketed or presented as feeding
bottles, especially if they are pictured with a nipple. So Medela could
have on its website and in print ads a picture of collection/storage
containers. This would be a bottle with a cap on it (no nipple unit).
The text would say "storage containers." There would be no mention of
also using them for feeding, even though we all know that they can and
will be used that way. The Code looks only at the marketing piece, not
the selling of the product. The packaging of the bottles also needs to
be Code compliant. The box or package that the bottle comes in would
have a picture of the bottle with a cap on it, not a nipple. The box
would list the contents. Nipples could be included inside the package
and listed on the contents of the package, they just could not be
pictured on the box. Medela could put a pack shot on its website that
includes feeding bottles and nipples with text that simply describes
the product, not idealizes its use. There are just so many nuances and
varying interpretations of the Code that during the work with Evenflo
we were forced to look more closely at all the small details and
learned a great deal in the process. Betty Sterken from INFACT Canada
and Joo Kean and Annalies Allain at ICDC were so helpful in walking
through the sticky issues.
