To give a quick (and consummate legal answer): it depends. Mainly it
depends on the venue of the recording. State to state, it varies between a
one party consent (only one person has to know that it is being recorded) to
a two party consent (both parties-or more if there are multiple-have to
consent to the recording). (Most notably Linda Tripp recording the
conversation with Monica Lewinsky and getting two felony convictions for her
trouble.)
Oklahoma, I know, is a one party consent state and there are others out
there. If I know which state, I could probably do a quick legal search. If
it's outside the U.S., again, it would all depend.

Subject: Consent issue

Hello everyone
One of my clients recorded a session we had in her home without my
knowledge. I realised after 15 minutes or so but felt quite annoyed she
didnt tell me when I arrived. Where do I stand here? I realise that the
law in the USA is different to other countries but Im sure the principal
is the same. You dont tape anyone without their consent.
What was the best way to respond to this? When i saw a light flashing on
the camera I asked was it recording. The mum replied yes - thats ok isnt
it? If i said no it looks like I dont want them to be able to recap on
what Ive said. But i did feel that I had been set up. Has this happened to
anyone else?
I think they should have asked me and then I would have consented to them
taping latching and positioning piece for a few minutes. I give all my
clients written instructions also.
Anyone out there with wise words....
Nicola O'Byrne
