I have spoken with Jon Rosenburg MD of the DHHS.  He is correct.  The law includes human milk and always has, but in the past was only applied to milk banks or depots, not every hospital that handles human milk.  Every hospital that handles human milk has policies and procedures re its handling -JCAHO requirement and state health dept requirement.  
 
I am awaiting an explanation of why the Tissue Bank Branch has now decided to enforce the law (besides generating revenue ~ $1,000 per hospital).
