Cathy, you wrote,
"As a subscriber to Lactnet and also a member of the Board of Directors =
of
IBLCE, it came to my attention that there was a recent unauthorized use =
of
the IBCLC certification mark. A Lactnet subscriber signed her name =
"IBCLC
(student)", our legal council has advised us that any person using the =
term
"IBCLC (student)" has infringed upon the IBLCE's "IBCLC" certification =
mark
because they have used a confusingly similar mark. IBLCE could initiate
legal action if the individual continues to use the mark. In all
probability, this subscriber did not mean to infringe or confuse, but =
rather
only to announce that she was studying for the exam. In future it is =
better
to state that one is preparing for the exam and hopes to take it next =
summer
rather than use the designation IBCLC student."
I would like to donate my IBCLC credentials to this student so that she won't
have to face a lawsuit on infringement of the IBCLC certification mark.
