I would add two other factors contributing to the huge increases in
malpractice insurance: the false culturally-implied promise of modern
medicine that every baby will be perfect (even 2 generations ago people
really understood that sometimes babies died or had malformations or
neurological injuries and it wasn't necessarily anyone's "fault") and
the reduction in time spent with individual patients, which hampers
communication. I once attended a "protect yourself from malpractice"
session where the presenting attorney said that the number one cause of
malpractice suits was poor communication between health care provider
and patient/family. All of these need changing.
