Chalk this up to "Great American Myth".  I suspect it's something
perpetuated ay (not so) Great American Exterminators who are actually not
inclined to take on "pests" who fight back.  Based on personal experience
involving fine neighbors, environmental enforcement officers and Department
of Environmental Conservation investigators, a home owner is allowed to
exterminate anything they damn well please as long as the "pest" is A) on
the home owner's property and B) the "pest" is not on the protected and/or
endangered species list.  Honey bees nesting in walls/soffits/trees/ANYTHING
are fair game if the property owner does not want them there.  This property
owner right extends to exterminators as the property owner's agent provided
A & B do not apply.
