While we may believe that the WHO Code applies to the U.S., it is obvious that Nestle believes otherwise. The WHO Code provided alot of flexibility for countries to implement it(in recognition of the diversity of cultural practices regarding breastfeeding). I believe that the U.S. has adapted it to the needs of the abm companies..meaning our government has chosen to look the other way while abm companies do as they please. Abm companies have a great deal of money, power and influence(to say it mildly). Laws can be put on the books but mean nothing unless they are enforced. For instance, Florida has a law on the books that a woman who is breastfeeding can breasfeed wherever she happens to be(discreetly or not..my words). Despite that law, women are still being asked to leave restaurants, unemployment offices, etc.(I know this because moms have told me about being asked to leave, as recently as a month ago. Do these moms pursue litagation? No...for a variety of reasons) As far as I know, there are no penalties/designated fines involved in discriminating against a breastfeeding woman in Florida. I guess what I am saying is a law is as good as a community willing to enforce it and willing to apply penalties to those who transgress that law. Valerie W.
