> Hi All, > I think if we stick to "THIS pump didn't work for ME, and I'd like to return > it", rather than "My LC told me that this pump was garbage and this other one > that she's renting to me is much better..." then we are not at risk. > Although we all know that those little *electric* store bought pumps are > mostly garbage, IMHO, as long as we don't tell the moms "Yes, dear I know that > XYZ brand is a horrid little nipple ripper and that it is the cause of your > sore nipples...", I think we are ok. I tell my moms that some of those pumps > work for some moms, but that mostly I have heard that they don't work *as > well* as the ones we all know are the best. I think our Lawyers on line would > know more about this, though. I could be totally wrong! Liz...Rachel...? Jay > CLE There is no such thing as litigation-risk-free behavior in the society we live in, but your suggestion certainly reduces the risk that the pump manufacturer can come after you for slandering their product. And, more to the point, it is more completely accurate and helpful to tell someone that they should return the pump if it doesn't work *for them* rather than to tell them your overall impression of success with the pump. The individual woman in front of you has no real reason to be interested in whether 5% or 90% of women who use this pump are getting inadequate performance from it; she is only concerned that it doesn't work for *her*. If lots of women return the pump for that reason, the manufacturer will be able to draw the obvious conclusion, so you don't have to. It just occured to me that the much stickier situation is when a client comes to you in advance of having tried a pump, asking for your impression of this pump. That is a whole 'nother kettle of fish. If you think, based on your clinical experience, that it is a crappy pump, you need to be able to convey that without putting yourself at risk. I am going to think about this today, and post my thoughts later. J.
