I think that ABA was asked at one time to accredit a Code violator as a Breastfeeding Friendly Workplace. As I recall a decision was made not to because accreditation could be used to "white wash" (a breastfeeding support version of greenwash) the organisation- ie to sell it as a good corporate citizen. 
On your scenario Liz...glad I'm not an IBCLC to attempt to sort that one! It's not clear cut. Fortunately things are usually pretty clear. Those who work on infant formula manufacturer helplines have a dual marketing/health worker role and that is in breach of the Code. There's no ambiguity there.
