As a prior L&D nurse and having been thoroughly indoctrinated into the "fear of litigation" culture that exists in US hospitals, I agree that this new SoP issue seems to arise out of a real or perceived threat of lawsuits. What is astonishing though, is that as RN's we are trained that if someone gives us instructions to do the wrong thing, it is our responsibility to speak up, that we may lose our license and/or be sued, if we make an error, even if we were following an order from an MD, when we made the error. This seems logical and protective. Encouraging independent thinking helps prevent errors, it doesn't encourage them. With the new SoP, it seems the situation has been reversed. If we are aware of a situation where an error is being made,we are to remain silent, guaranteeing that the error will remain uncorrected. I do take it very seriously when I find myself in the position of disagreeing with someone's HCP, but have been delighted to find that when I provide the rationale for my thinking, I have almost invariably been able to convince the HCP to change their mind. In cases where that is not possible, most often with frenulum issues, I have recommended second opinions by other HCP's, which can't possibly be out of our scope of practice, second opinions being a cornerstone of safe, modern medicine. I do hope that this rule is changed, as the stifling of free thought and discussion is as dangerous for individuals as it is for society as a whole.
