Ben & Jerry's NEVER lost control of their company and they have NEVER been owned by Nestlé. The company that was very quietly bought out by Nestlé the day after Christmas in 2001 was HAAGEN-DAZS. Many Vermonters, also the home of activist Governor Howard Dean, actually own stock in B&J, and I don't think they'd EVER let Ben, Jerry or current CEO Yves Couette sell out to Nestlé.
