<< Since the policy as it is stated now was not in effect at the
time MJ started using our faux pas, I think the best idea would be for the
ILCA
Board to simply state to MJ what the CURRENT policy is, and ask them to cease
&
desist. Whether or not they have to legally comply is anyone's guess since
they are simply continuing a practice that was started before the policy came
into effect.

In essence, I guess I'm saying that since the JHL that made the statement
does not have the policy Maureen quoted in it, whether that would give them
their
legal leg, so to speak.

I would think that any printed materials created using the original promo
would not have to be destroyed, but that any new promotional materials would have
to abide by the guidelines in effect at the time those materials were
created. So, if the promotional materials are copywrited today, I cannot believe they
can make the argument that they have the right to use ILCA guidelines that
existed years earlier. That is like saying I can drive legally w/o my seatbelt
b/c I started driving without it when it was legal to do so.
