I read this question before going to bed last night and was pondering it. Liz articulated my thoughts precisely. It really in the end is a political question, intertwined with the issue of abortion. In a few weeks, I will start representing children in parental termination cases--not the state (CPS) and not the the parent. I will likely get more of any insight.
I'm also glad several people have pointed out that many child protective services often overreact (and sadly in many cases, underreact). We hear of cases where mother is told to stop breastfeeding, or we call CPS on you, b/c BF is always the problem!  Mother, of course, stops b/c she's scared of having her child taken away.
