There are two copyrights which apply to recordings.  If the music is
under copyright, there is a mechanical license fee the record company
pays the copyright holder.  If the composer's music is public domain,
it is violation of the copyright of the music.  However, with few
exceptions, the new copyright laws of the US place just about every
recording ever made under copyright until the year 2067.

You might want to consult the Council on Library and Information Resources

It will give you some idea about the situation.  Outside the US, in most
of the rest of the world, the copyright of printed music is for 50 years
past the death of the composer and recordings are covered from 50 years
from their initial date of issue.
