I do recall as case here in NY where a beekeeper was suspected of hoarding AFB infected combs in a storage building. A warrant was obtained and enforced by aid of State Troopers. I don't recall the details but it occurred somewhere between Utica and Syracuse.

In Ohio an Apiary Inspector, County or State I don't recall, burned a beekeepers hives w/out permission to be on his property and that beekeeper sued the State. This action almost did away w/ Apiary Inspection in OH. It made OH Apiary Inspection change it's methods.

My recollection is that beekeepers always had the option of refusal. If, for some reason, a beekeeper didn't want their hives inspected I was told to say okay and look elsewhere. No inspection was ever forced upon anyone, when I worked. I was also told that if someone didn't want to be registered that I should leave them alone.
