I'd like to express my discomfort with the idea of lawsuits. While I agree
that it is wrong and potentially harmful for a nurse to give ABM without
consent, and many times a case could be made for a suit, I don't generally
believe lawsuits will do much to solve the *overall* problem. I do think
they contribute to a CYA approach to medical care (rather than a careful
individual approach).
It seems wholey appropriate to write to the nurse, the nurses association,
the hospital administration, the doctors, and so on; communication of that
sort can help in a positive way. However, I believe lawsuits put up
barriers to real communication and sense of community, which are important
when it comes time to work through our differences and solve big problems.
Consider what you would want to happen if you did something that upset
someone or that they considered wrong or potentially harmful. I expect
that you'd appreciate honest and open communication about the problem
rather than a lawsuit. Food for thought...
