The case of Newton vs NYS failed on its own lack of merit. Some of the bee yards were 50 miles from the spray area. There are many ironies but one of them is that the DDT was applied to maple trees to protect the interests of maple sirup producers, who are in direct competition with honey producers for the market of luxury sweets. This is all a matter of public record.

Mr. Wahl at first thought a new disease had struck his bees and made inquiries in Syracuse on May 22d about new diseases (II, 435; Ill, 689-690). It was not until after he had read the article in a local newspaper sometime after May 22d about the State's spray program (II, 427, 446) that he first speculated as to the possibility of insecticide poisoning (II, 576; Ex. V). A month later, however, on June 22d, he was still apparently considering disease because as President of the Beekeepers Association he wrote and mailed a notice of a meeting to "compare notes on what appears to be a new disease"
