NAGPRA and it implementing regulations relate to Native American human remains, funerary objects, sacred objects, and objects of cultural patrimony found on federal land or housed in museums receiving federal funds. The key to a federal nexus under NAGPRA is federal funding unlike Section 106 that provides for a broader federal involvement through permits as well as federal funding. It seems in this issue that only state laws would be pertinent.

As far as I know or have been taught, NAGPRA only applies to human remains
found on tribal or federal lands, although mitigation may be extended to
burials on private land affected by federally-funded/permitted projects
under Section 106. Wouldn't it be nice and easy if NAGPRA simply applied to
all native burials on any land regardless of legal ownership:):):)
