I have not heard the term CAFO, but here in California most agricultural
operations are exempt from environmental review. Of course, if you can make the
case there is a federal undertaking, then Section 106 would apply. Where we do
get involved were violations of vector control issues, such as too much
chicken poop with swarms of insects and then it was too late for the archaeology.
The agricultural lobby is really powerful and pulls at the heart strings of
most politicians. Aside from these issues, all modern agricultural operations
that I have seen are highly destructive to the land. Modern plowing for
tomato fields cut twelve feet into the soil to aerate the growing area and the
fertilizers, pesticides, and soil supplements are highly destructive on
organics. Chicken ranchers bulldoze dozens of acres to level off the ground and
undergrounding of utilities, grading roads, and stripping of topsoil virtually
eliminate archaeology. Good luck in dealing with the hog farms!
