I imagine laws and enforcement vary widely from state to state.
We have placed (either on a sign or printed on tickets) a statement to
the effect of "we're going to be taking pictures that will be used for
advertising, if you do not want you photo taken you have to take the
initiative to make sure we know that."
In some cases the answer will be "if you don't want your picture taken
don't be here", in other cases it will be "we will not use X photo
because you asked us not too". As far as I know we've had neutral
reactions to this (I personally don't know of any instance where we had
to stop using a photo).
