In California, State Health law requires contacting the Coroner before
exhumation of human remains. There is a very well defined procedure for making all
attempts to contact the nearest relatives. When all procedures have been
exhausted, then the Coroner can issue a permit to exhume. Of course, a Court
Order can also direct such an excavation. Thirty years ago, there had to be 6
burials to qualify as a "cemetery" but the current law begins with one. Digging
for the fun of it would not qualify under California law, especially if the
nearest relatives objected.
