Under copyright laws the composer of any variations on "Black Magic Woman"
would need to obtain permission from the copyright owner. They could
negotiate any terms (including financial and those related to attribution)
that they found mutually acceptable. If the composer didn't obtain
permission he would be wide open for a (justifiable) lawsuit.
The reference to "BMW" is interesting since an arrangement of it was played
on the same concert that the first ever public performance of any of my own
music (which does not quote Santana or anybody else).
