The issue in TX is that there is also a trespassing statute that permits a business owner to ask a person to leave, and s/he declines, the police can be called. Thus, there have been incidents in TX where the trespassing law has "trumped" the the BF law. I believe there is proposed legislation to deal with this problem, and impose penalties on those who don't comply with the BFIP law.  Many other states have BFIP laws that have no teeth, but for some reason, it seems to be Texas where the majority of the problems arise.
