Being another New Yorker, living in a swamp of litigation, I have to say I completely agree with Susan's post. Not only do we have the four year old being sued, but a dry cleaners here was actually sued for a million dollars or something close, can't remember the exact number, because they ruined a guy's pair of pants. 

I loved all the posts about empowering women to work together for the greater good. And I believe along with Ann Frank that people are good at heart. But I would add the caveat "most" to that. 

I think Susan's example was perfect for this scenario, because of the idiocy of the suit, but also because the death was ultimatedly unconnected to the hip injury. I can so see a case where a newborn might get sick and the milk be blamed, whether or not that was ultimately the problem in the first place...think about all the misconceptions there are out there floating around about milk, even among people who should know better. And even if a lawsuit ultimately goes away, hiring the lawyers necessary to defend you until it does can cost a fortune....

A legal document or waiver of some kind seems like a very good idea to me in this scenario in this country.... I realize that there are  places in the world where people do not live under the shadow of potential litigation, but being a former OB nurse, I can tell you that the United States is not one of them.
