Unfortunatly, the HIPPA rules will not be a failsafe method for privacy.
There are many agencies that will be permitted (PUBLIC HEALTH AGENCIES,
hospitals, doctors, the FDA, law enforcement, etc.) access your health
records without your permission, including doctors that are not treating you.
 There is also a central database that health records will be dumped into
after we all are given a "unique" health identifier.
There are also some powerful industry groups (formula companies...........)
that support pre-empting any state rules regarding a patient giving
permission to access  his/her records.  Given past lobbying success, it's
likely that any state laws that have a consent provision soon could be
pre-empted by the federal rule that allows access without permission.
