NABA has just received the acknowledgement letters from the Federal Trade Commission and the Food and Drug Administration regarding the joint petitions filed along with the Cornucopia Institute?regarding DHA warning labels and false and misleading advertising. In the FTC letter it was mentioned that Martek, the maker of the DHA/ARA oil blend, had already been investigated by the FTC regarding its claims relating to mental and visual development benefits for infants consuming the supplemented formula. It encouraged Martek to "exercise caution in characterizing the extent or permanence of any benefits and in describing the certainty of the supporting science in any future advertising." It remains important for breastfeeding advocates to correspond with the FTC regarding the false and misleading nature of the formula ads. The quantity of letters is important as the FTC needs to see that this affects a large number of people.

The FDA assigned a docket number to the petition for a warning label on DHA supplemented formula which is FDA-2008-P-0074-0001/CP to which you can refer when you write to them?in support of such a label. Pease consider writing to both agencies and making sure that all adverse side effects you see in babies fed these formulas are reported to the FDA MedWatch program.
