Hi, all.

First, let me thank all of you who took the time to write me individually in
January when my Domperidone nightmare began. I really do appreciate the
support. As is often said on this list, I don't know if I could handle this
job without it. I feel like I am always swimming against the tide...and
that can easily lead to self-doubt.

After I heard the NE state medical board had decided to ask the state
attorney general's office to ask me to sign an "assurance of compliance", I
hired an attorney familiar with this area. (FYI---in retrospect my mistake
was that I spoke with the "investigator" from the state in November over the
phone in the middle of a busy day when he called to ask me questions. I
SHOULD have told him I would meet with him and my attorney. Live and learn.
When I saw what he reported to the Board, I was amazed. I was horribly
misquoted) Anyway, my attorney played the game with the assistant attorney
general, posturing over the phone to get my "file", looked it over, told her
he didn't see how my prescribing Domperidone was actually "illegal". The
executive board of ABM even was kind enough to write me a letter of
support...but she was not interested. Ultimately she said she was not going
to debate it with him...unless he wanted to take it to an official hearing.

He advised me to sign the assurance of compliance (which states I will not
prescribe Domperidone unless I obtain a number from the FDA allowing me to
investigate the drug, or it becomes FDA approved.) because if we went to
hearing it would cost me a lot more money, and I would either "win or
lose"...meaning if I "won", everything would be dropped, but if I "lost"
some form of disciplinary action would have to be taken against my license.
The "letter of assurance"option, which is called a "nondisciplinary action"
would disappear.

The attny general agreed to change the wording in the letter to remove the
words "illegal drug" and replace them with "unapproved drug". And I signed
it. I just cannot trust the system anymore to do what is "right".

So it is over, after a lot of stress, soul-searching, $850 in attorney fees,
and a smudge on my official record. (the letter goes in my "file" on the
internet)

If anyone who originally offered to help with fees is still interested,
(even tho I did not "fight" very long) you can send a tax-deductible
donation to:
