Since code monitoring reports take time to come out it is might be
appropriate for organisations to ask the International Code Documentation
Centre if particular companies are in breach. It's their job to look at
these things. I recently sent an advertisment off Medela's Australian
website to ICDC and asked if it was in breach, they were able to answer that
it was and explain why it was. I don't know if this is something that they
are prepared to do for organisations on a regular basis.
Personally, I think the issue is pretty clear with a wholly owned company
(eg Pigeon owning Lansinoh- stated aim to make money from the lactation
market), but greyer with situations such as Nestle part owning Loreal (but
then is Loreal seeking to enter the marketing in anything to do with
lactation??). It is difficult if not impossible to keep track of who owns
what but I guess the main question is what you do *when* you discover a
change in ownership.

A timely set of questions, Nina -- questions that many organizations are
struggling with.

At the 2007 ILCA Conference, the Board of Directors' Issues Forum discussed
advertisers in the Conference Exhibit Hall.  ILCA is unusual in that it has
Code support actually written into its organizational by-laws.  But ILCA is
not an International [WHO] Code monitoring organization -- it is a
professional organization, designed to provide education and professional
development in lactation consultancy.  Currently, ILCA relies on reports
issued by an outside monitor (IBFAN) to determine Code compliance.  Their
most recent report is from 2004.

So I pose it to you, Lactnetters:  how would *you,* trained in lactation
consultancy, keep track of corporate mergers, around the globe?  What about
a company that is "firewalled" from its corporate owners, compliant in its
own right with the Code, but owned once-removed by an entity that is not?
What about the company that used to be non-compliant, but is now making
visible and public attempts to comply?  The ILCA Board is examining this
issue as we speak, in anticipation of inquiries for the 2008 conference.
I'd love someone to give me a black-and-white answer.
