Information about public breastfeeding for fairground staff, administrators
and security personnel:

 

Breastfeeding is protected by law. A woman may breastfeed anywhere she
already has a right to be. During the County Fair, this would include all
public areas of the fairgrounds. This is her legal right under California
Civil Code 43.3.

  

Question: You are approached by a fairgoer who is upset that a woman is
breastfeeding her child in a public area.  He complains that he is offended.
What do you do?

 

Answer: The answer to this is the same as the answer to fairgoers who claim
to be offended by seeing someone of a different race or religion, or someone
who is disabled, at the county fair. The real offense would be to ask a
disabled person, a person of color, or a person of another faith to go eat
in the bathroom so other fairgoers didn't have to see him or her. More
importantly, it would be a violation of his or her civil rights.
Breastfeeding is also a protected civil right. 

 

All you need to tell the complainant is that Nevada County protects a baby's
right to be breastfed, and suggest he might want to remove himself to a
different area of the fairgrounds if he is uncomfortable. You may not
suggest to the woman that she move, add further covering, or artificially
feed instead. Your role is to protect the woman and baby's civil rights by
offering guidance and information to the complainant.

 

In a situation where the woman herself approaches you and asks where she can
breastfeed her child privately, you may inform her that there is an infant
feeding area in the Sierra College Children's Booth, near the Senior Center.
It is very important that you make it clear that she is welcome to
breastfeed her child wherever she wishes. The infant feeding area is offered
for women who are looking for a quieter, cooler, less dusty place to nurse.
You should not approach breastfeeding women and suggest they move if they
appear to be happy where they are. Any attempt to "herd" breastfeeding women
into this area could be misinterpreted as an effort to move them out of the
public view, a violation of California Civil Statutes.
