Donna,

 To some degree, this depends on where you are from, state laws vary.

 There is a law under consideration on Congress that would fill this gap and include salaried employee, the Supporting Working Moms Act to extend lactation accommodation protections to salaried employees, including elementary and secondary school teachers. (http://www.usbreastfeeding.org/swma) It was supposed to come up for a vote in the last week or so, I don’t know its status now.



In the meantime, is the mom a member of a union that could help advocate for her. Are there other teachers in her area that have faced similar situation she can brainstorm with, get advice from? What grade does she teach? What kind of down time is built into her schedule?



Good luck, happy to brainstorm further, until the law catches up with mom’s basic needs.

Subject: Pumping and the law



I have a mom questioning her rights to be given time to pump.  She is a teacher which makes her a salaried employee.  Everything we are reading states the protection is for hourly employees. The principal is telling her to figure it out.  Are we missing something?
