Code issues can sometimes be rather difficult to interpret. Having
worked to help the Evenflo company meet its obligations under the Code,
I had many questions about bottles within the Code. Any bottle
represented as a feeding bottle is forbidden by the Code to be marketed
to the public. However, collection and storage containers are not
within the scope of the Code and are permitted to be marketed to the
public. I have been through this with ICDC in Penang and marketing
storage containers does not violate the Code. A company who is
marketing feeding bottles needs to modify its website, change
packaging, and correct print ads to meet its obligations under the
Code. Feeding bottles are permitted to be pictured on a website if it
is what is called a "pack shot." A pack shot is a picture of all of the
products in question in one picture. A company is permitted to state
that it manufactures and sells that product but there can be no
marketing text. Meeting Code obligations is not a simple matter. It
takes a lot of effort to check that each aspect of manufacturing and
selling does not turn into marketing.
