LEGISLATION UPDATE

Today, February 17, 1999, Ohio State Senator Rhine McLin, Democrat from
Dayton, held a press conference introducing legislation to protect
breastfeeding in public. Ann Twiggs, President of the Ohio Lactation
Consultant Association also spoke at the news conference and
congratulated Senator McLin on introducing this important piece of
legislation.

The proposed legislation reads as follows:

to amend section 2907.01 and to enact section 9.65 of the Revised Code
to declare that a mother generally has the right to breast-feed her
child in any public or private location and to exclude from the
definition of "nudity" in the sex offense laws the showing of the breast
of a mother who is breast-feeding her child.



BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

Section 1. That the section 2907.01 be amended and section 9.65 of the
Revised Code be enacted to read as follows:

Sec. 9.65. NOTWITHSTANDING ANY OTHER PROVISION OF LAW, A MOTHER MAY
BREAST-FEED HER CHILD IN ANY PUBLIC OR PRIVATE LOCATION WHERE THE MOTHER
AND THE CHILD OTHERWISE ARE AUTHORIZED TO BE PRESENT, EXCEPT THE PRIVATE
HOME OR RESIDENCE OF ANOTHER IF THE MOTHER'S BREAST-FEEDING IS LIKELY TO
BE VIEWED BY AND AFFRONT THE OWNER OR ANY OCCUPANT OF THE PRIVATE HOME
OR RESIDENCE. A MOTHER MAY BREAST-FEED HER CHILD UNDER THIS SECTION
IRRESPECTIVE OF WHETHER THE NIPPLE OF THE MOTHER'S BREAST IS UNCOVERED
DURING OR INCIDENTAL TO THE BREAST-FEEDING.

In the Senate, the proposed bill also received co-sponsorship from
Senators Gardner Republican from Madison, Ohio, Senator Hagan Democrat
from Youngstown and Senator Watchman, Republican. Representative Dixie
Allen, Democrat of Dayton is introducing the bill in the Ohio House of
Representatives.

Breastfeeding advocates are strongly encouraged to call their
legislators and ask them to co-sponsor the bill. Co-sponsors can sign up
through March 1, 1999. The bill needs to go through committee before
being presented to the legislator. This process requires that advocates
attend these meetings and speak on behalf of the bill. The Ohio
Lactation Consultant association will be calling their members when
advocates are needed so that we can have a strong presence. This bill
must not be allowed to die. Breastfeeding advocates throughout Ohio need
to take part in ensuring its passage.
