I have long maintained that Code analysis is nothing more than a subset of conflict of interest analysis. Your hospital is absolutely acting as a shill for any company whose products its distributes, as samples, to patients - regardless of the Code relevance; regardless of BFHI status. The facility may well have policies in place against wept get or offering free samples, whether those samples are pharmaceuticals, medical devices, or Code covered products.

All that said, the requirements for BFH nude adherence to the ode. And the folks at IBFAN/ICDC (the international Code experts) have long said that when a company is not meeting Ts obligations under the Code, the entire company and all its product line are said to be in violation. And the situation you describe -- where a Code-violator's branding and colors are so recognizable than non-Code-related products are instantly identified as coming from that company - is the very sort of predatory, brand-specific marketing scheme the Code is designed to eschew.
