I don't think suing a hospital (not the formula company) for giving formula against a parent's wishes would necessarily be a "frivolous lawsuit." We know what just one bottle of formula can do to a baby's system! At the minimum, I think hospitals should handle the feeding of unrequested formula in the same way they handle medication errors.

Sure, if mothers would keep their babies with them at all times, then they wouldn't take the chance of their babies getting some formula. But shouldn't any hospital patient be able to trust the nurses with her (or his) wishes? It seems to me that hospital administrators, even if they think formula is no big deal, wouldn't want to get a reputation of having untrustworthy staff; perhaps that's the angle that should be taken with them.
