OK, here's the deal with patents as I understand it from my dh, who
works for a major drug company. Companies spend literally millions of
dollars bringing a drug to market. They have to file for a patent long
before the drug gets to market, while it's still in development, so that
by the time they get it to market, they only have a few years, give or
take, to turn a profit on their investment. The point with Domperidone
is that it is off-patent so any little tom, dick or harry pharmaceutical
company (and there are many, many making money on generics) can make a
generic and profit from it. Once the generics hit the market, there is
little profit to be made by the original company that "invented" the
drug. Therefore, there is no profit in it for Jansen to pursue approval
of this drug. I'm not sure about the extended release issue, meaning
you can renew the patent by making such a small change. I will have to
ask my husband, but I know they are challenging such patents in court at
record rates these days, because the generic companies want a piece of
the action so badly. (It's rather like the sharks circling!) So,
approval of Domperidone doesn't sound promising, and I'm beginning to
wonder about Reglan's future in this capacity, since it has more
potential for side effects.

Not meaning to rain on anyone's parade and sure hoping I'm wrong!!!
Marsha
