ACCORDING TO DAVID CLARK UNICEF  LAWYER WHOM I CONSULTED I AM CORRECT.

FURTHERMORE HE HAD THIS TO ADD "The US went along with the adoption of WHA
resolution 47.5 in 1994. That resolution was adopted by consensus, and the
US was party to that consensus. WHA 47.5 recalls previous resolutions,
including resolution WHA34.22 which includes the Code. 47.5 also reaffirms
the states' support for all the resolutions and reiterates the
recommendations to member states contained in them. This includes the
recommendation to all member states to implement the COde.

FURTHERMORE THE BABY FOOD COMPANIES WHO WERE PART OF THE DRAFTING TEAM
HELPED DRAFT THE CODE AND THEY AGREED TO IT

ARTICLE 11.3 OF THE CODE CALLS ON THEM TO APPLY THE CODE
 This Article states that manufacturers and distributors of products covered
by the Code must make sure that they comply with the Code irrespective of
measures that have, or have not been taken by others to implement it. Thus
even if no action has been  taken in a country to give effect to the Code
and subsequent relevant Resolutions, all companies must still comply.

 Manufacturers and distributors of breastmilk substitutes, feeding bottles
and teats must comply with the Code and resolutions irrespective of action
taken
by national authorities to translate them into domestic law.

I HOPE CLARIFIES THE US POSITION AND THE OBLIGATION OF THE COMPANIES NOT TO
LOOK LIKE THEY ARE VIOLATING THE CODE
