I would be quite disturbed to know that a childcare facility was feeding
my baby formula and not the EMM I'd left.  They have absolutely no right
to make such a choice!  However, that attitude may not get this poor
mother very far.  I'd tend to approach a doctor and ask for note stating
that my baby was to receive breastmilk only for health reasons.  A
doctor's note may give some clout and also get the mom "off the hook" if
the care providers think she's a pain for making their jobs a bit more
challenging!
