<<<I do have a mother of a 12 mo old baby, whose employer is refusing to
give her additional time for pumping breaks stating that by the law she
is allowed pumping breaks only till the baby will turn 1 yo.>>>>
Unfortunately, that is accurate.
Under General Requirements it states -
"Employers are required to provide "reasonable break time for an employee
to express breast milk for her nursing child for 1 year after the child's
birth each time such employee has need to express the milk."
It continues...
"The FLSA requirement of break time for nursing mothers to express breast
milk does not preempt State laws that provide greater protections to
employees (for example, providing compensated break time, providing break
time for exempt employees, or providing break time beyond 1 year after the
child's birth).
What a shame the employer does not see the need to continue to give her
time to pump. She has does beautifully to breastfeed and pump this long.
