Dear all:
According to my husband's profession and all their HIPAA releases, you are NOT allowed to withhold treatment from a client if they don't want to share information. The original intent of HIPAA was to protect clients from having their information passed around without their consent. The forms my husband uses are in direct contradiction with the interpretation that we have to have informed consent to see someone. I read this as a violation of patient's rights unless there is frank child abuse involved, in which case we and anyone else witnessing the abuse are obliged to report.
Best,
Susan E. Burger, MHS, PhD, IBCLC.
