The answer to the question of whether it is a kickback for a commercial
vendor to pay a healthcare provider a fee every time a commercial sale is
made to a customer sent by the healthcare provider is .... yes.
Some kick-backs are okay: if your florist or car mechanic is willing to
give you a discount if you send another customer her way, who cares? It is
a way to attract and keep customers.
But IBCLCs are in the business of providing healthcare. It certainly gives
rise to the appearance of a conflict of interest if the IBCLC gets paid
every time the vendor makes a sale to a referred customer. It calls into
question whether the mother was sent to the shop because she really, truly
did need a product to address her lactation issue ... or she was sent to
the shop because of the "ka-ching incentive."
