The USA does not have any mechanism to enforce the WHO Code. We are relying
on the good will of formula/bottle/teat manufacturers to abide by the Code.
Yeah, that's been a real winner, hasn't it?
Freedom of speech as protected by the First Amendment of the US Constitution
goes to one's freedom to speak against the government, without fear of
retribution. Enfamil's claims are simply a form of commercial speech,
which is, in fact, a highly regulated form of speech. So while we can't
"catch" them on WHO Code grounds, we can try to use federal regulations
promulgated by the Food and Drug Administraiton, or the Federal Trade Cmsn,
requiring truth in advertising.
