I imagine most parents would want the photos, and not suspect their names
being sold to a third party. When I was on ob at 2 different hospitals,
photos were taken of every baby. "Time for photos" as the babies were
wheeled away. If the parent wanted copies, they signed something, and all
the parents I worked with did so.
Like everything else, it should be an *informed* choice.

The photo company has the mothers sign a waiver of hippa (privacy) if the
parents want the photos. The photos are choice, not mandatory.
