The Nebraska case I mentioned was a home birth. I can't recall now precisely how she came to the attention of her state CPS, though there had been litigation over her refusal of testing for her previous child so it is possible she was being watched in some way. :(  The case is being litigated further.  As I recall how the Complaint reads one of the primary causes of action is that a religious exemption is a constitutional requirement, though I think there is also a Count in the Complaint concerning the mother being denied the ability to breastfeed the child while he was in state custody.  Last I checked this case was at the beginning of what will likely be a long legal journey.
