Yes, and especially when formula has been given not only without
consent, but against the expressed wishes of the parent!  Same thing
for a pacifier.  If the parent has requested none (or in my opinion
if they have not specifically said it's OK to give one) and baby
winds up with a pacifier, I think they have a right to sue the
hospital that interfered with their wishes without an absolute
medical reason and possibly even the manufacturer in the case of
formula.
It wasn't until peole began suing the tobacco companies for not
revealing the risks of smoking (and even covering up knowledge of
those risks) that something was done to reduce the influence of the
tobacco salespeople!  It shouldn't be necessary to clog up the legal
system with such suits, but unfortunately, sometimes that's what it
takes.  Money talks where the voices of humans who suffer from the
money-first attitudes is ignored!
