Dear Friends:
I can't think of a more blatant example of restraint of trade, which
merits a lawsuit. When one professional denigrates another professional in print,
this is fodder that we can use! It is exclusionary. Would this physician write
an order telling a pediatrician or a nurse or dietician to stay away from
'his mothers' ?
The AMA was found to be practicing in restraint of trade of chiropractors
in a 10-year lawsuit settled in Federal District court. (It was the district
with Illinois in it, I don't remember the name of the District.) The suit was
settled in the mid or late 80s.
Sounds like a similar situation to me.
