There may well soon be another to add to the list.
The highest administrative court in France, the Council of State, examined Monday, 24 January 2011, three demands made by the National Union of French Apiculture and found against the decisions allowing the marketing of CRUISER 350 which French beekeepers have contested for years.
The Rapporteur Public, an official of the court whose role is to give his opinion of a plaintiff's case and the action to be taken, asked that the authorization for the pesticide in 2008, 2009, 2010, be cancelled. He also asked for costs to be awarded against the Minister of Agriculture.
The Minister had deviously granted temporary 12 month permits for Cruiser for the three consecutive years whereas French law and European legislation require 10 year authorisations to be given, but only after the product has been shown to be safe.
In 2008 the Ministry set up a tenuous scheme to evaluate the risks but this protocol has never been legally approved and the conclusions drawn from the results are discredited.
The Court has 15 days to make a final judgement.
