Hello,
I would like to provide a few comments regarding the issue of illegal drug
use and breastfeeding or providing breastmilk.  It is important to
remember when we are providing information to mother or other
professionals on this topic that we must adhere to our individual local
and state laws.  The law regarding "transfer of an illegal substance to
another person" has been interpreted in several states to include these
drugs (marijuana, heroine, cocaine, methamphetamine etc) and breastmilk.
If we as professionals, whether LCs, nurses, MD, NP etc
provide "permission" or the means to provide breastmilk to an infant, we
can be found responsible under the umbrella of this law.  If you have
questions regarding your local/state statutes, contact your state's
Attorney General's office.  They can provide you with the law and its
interpretation.  If anyone has questions or comments regarding this post,
please contact me privately.
